SMS Terms
These SMS Terms ("SMS Terms") explain how Fair Lift LLC ("Fair Lift," "we," "us," or "our") uses SMS/text messaging in connection with the Fair Lift website, mobile application, and related services available through Fairlift.net (collectively, the "Service").
By providing your mobile telephone number and consenting to receive SMS messages from Fair Lift, you agree to these SMS Terms.
1. Purpose of SMS Communications

We will not use your telephone number to send:
- Promotional offers
- Advertisements
- Discounts
- Sales campaigns
- Marketing newsletters
- Third-party advertisements
Your consent to receive transactional SMS messages is not consent to receive marketing messages.
3. Consent to Receive SMS Messages
When you provide your mobile telephone number and elect to receive SMS communications, you consent to receive text messages from Fair Lift related to your account and use of the Service.
Consent is collected through an unchecked checkbox on the Create Account screen of the FairLift Rider and Driver apps, the "Text messages" switch inside each app, the driver waitlist form on Fairlift.net, or by texting START to a Fair Lift number. Each method and the exact wording shown is documented at /sms-opt-in.
Your consent is not a condition of purchasing goods or services from Fair Lift.
Because Fair Lift is designed as a ride-share and food delivery platform, certain SMS messages may be necessary to facilitate a ride or food delivery or protect the security of your account.
If you choose not to receive SMS communications, certain Service functionality may be unavailable or may require you to use another available communication method.
4. Message Frequency
Message frequency varies depending on your use of the Service.
For example, a user who requests or provides rides or food deliveries may receive messages associated with ride or delivery requests, confirmations, status changes, cancellations, receipts, authentication, or other events related to that activity.
Fair Lift does not send a fixed number of messages per day or month.
We will make reasonable efforts to limit SMS communications to messages that are relevant and necessary to providing the Service.
5. Message and Data Rates
Message and data rates may apply depending on your mobile carrier and wireless plan.
Fair Lift does not control charges imposed by your mobile carrier.
You are responsible for any applicable charges imposed by your wireless provider.
6. How to Stop SMS Messages
You may opt out of SMS communications at any time by replying:
STOP
to a Fair Lift SMS message.
After receiving your opt-out request, Fair Lift will take reasonable steps to stop sending non-essential SMS messages to the applicable telephone number.
Please understand that certain communications may still be sent when reasonably necessary to:
- Complete or secure an already-initiated transaction
- Provide an authentication or security code
- Comply with legal requirements
- Protect the security of your account
- Respond to a request you initiated
If you no longer wish to receive SMS messages but need to use the Fair Lift Service, alternative communication methods may be available through the website or application.

For assistance with Fair Lift SMS communications, reply:
HELP
to a Fair Lift SMS message, where supported.
You may also email support@fairlift.net.
8. Changing Your Telephone Number
You are responsible for ensuring that the mobile telephone number associated with your Fair Lift account is accurate and current.
If you change your telephone number, please update your Fair Lift account as soon as reasonably possible.
You should also notify Fair Lift if a telephone number associated with your account is no longer under your control.
Fair Lift is not responsible for messages delivered to a telephone number that you have provided to us if you fail to update your account after changing or losing control of that number.
9. Shared or Reassigned Telephone Numbers
You should not provide a telephone number that belongs to another person without that person's authorization.
If a telephone number associated with your account is reassigned to another person, please notify Fair Lift promptly so that we can update our records.
If you receive a Fair Lift SMS message intended for someone else, please contact us or use the available opt-out instructions rather than attempting to access or use information contained in the message.
10. Privacy
Fair Lift respects your privacy.
We collect and use telephone numbers and SMS-related information only as reasonably necessary to operate, secure, and support the Service.
Fair Lift does not sell your telephone number or SMS communication information to third parties. We do not share mobile numbers with third parties for their marketing or advertising.

Fair Lift may use third-party telecommunications, messaging, cloud, or technology providers to deliver SMS messages.
These providers may process your telephone number and message-delivery information as necessary to deliver messages on behalf of Fair Lift.
Third-party providers may have their own privacy policies and terms.
Fair Lift does not authorize these providers to use your telephone number for independent marketing on behalf of Fair Lift.
12. Delivery of Messages
Fair Lift makes reasonable efforts to deliver SMS messages promptly and reliably.
However, we cannot guarantee that every SMS message will be delivered immediately or successfully.
SMS delivery may be affected by circumstances outside Fair Lift's control, including:
- Mobile carrier outages
- Network congestion
- Device connectivity
- Incorrect telephone numbers
- Blocked messages
- Carrier filtering
- Wireless service interruptions
- Technical problems involving third-party messaging providers
Fair Lift is not responsible for delays or failures in SMS delivery caused by circumstances outside our reasonable control.
13. Security and Authentication Messages
Some SMS messages may contain one-time passwords, authentication codes, or other security-related information.
You should never share an authentication code with another person unless you are specifically instructed to do so through an official Fair Lift support process.
Fair Lift will not ask you to disclose a one-time authentication code through an unsolicited phone call, email, or text message.
If you believe that your account or telephone number has been compromised, contact Fair Lift promptly.
14. Transactional Nature of the Program
Fair Lift's SMS program is intended primarily to facilitate transactions and the operation of the Service.
Examples include communications necessary to coordinate a ride or food delivery between a customer and a driver, confirm a transaction, provide a receipt, authenticate an account, or communicate an important operational change.
Fair Lift does not use this program as a marketing subscription.
15. Changes to These SMS Terms
Fair Lift may update these SMS Terms from time to time to reflect changes to the Service, technology, legal requirements, or messaging practices.
